Terms and Conditions
1. Validity
These terms of trade govern the sale and supply of goods by Hogshead
Publishing Ltd to you. Hogshead Publishing Ltd may amend these terms
from time to time. You
shall be notified of any amendments by a notice on the Hogshead Publishing
Ltd web site.
2. Hogshead Publishing Ltd's Contract With You
When you place an order we will treat it as an offer to buy. Our acceptance of
your order by delivery of the goods constitutes a legally binding contract
between us on these terms and conditions.
Hogshead Publishing Ltd reserve the right to decline any order in the
case of obvious errors or inaccuracies regarding the goods or the order
appearing
on Hogshead Publishing Ltd's site or for unavailability (see 3. below).
Hogshead Publishing Ltd reserves the right to place restrictions on
the volume of any goods ordered. By placing an order for products with
age restrictions you declare that you are of legal age to purchase those products.
3. Pricing and Availability
The prices and availability of the goods are specified on the Hogshead
Publishing Ltd site. Such information is subject to change without
notice. Please ensure that you refresh you browser regularly to obtain the latest
prices. The price payable for the goods you order is as set out on our
website at the time you place your order or, if you order from one
of our catalogues, as set out in the catalogue from which you order
provided it is a current catalogue, plus any charges for carriage and
insurance as set out in the order form. We must receive payment for the whole of
the price of the goods you order, and any applicable charges for carriage
and insurance, before your order can be accepted unless we have agreed
otherwise in advance in writing.
4. Delivery of Goods
Hogshead Publishing Ltd shall deliver the goods ordered to the delivery address
which you supply. All delivery times quoted on the Hogshead Publishing Ltd site
are estimates only based on availability, normal processing and delivery
time. Title to the goods will pass to you on payment in full. Risk will pass to
you on delivery.
5. Hogshead Publishing Ltd Returns Policy.
You may cancel your order by giving us notice of cancellation within
14 days of the date of collection or delivery. Such notice may be given
by mailing, or emailing to the number or address set out on
our web site. If you are cancelling because of any problem with the
goods, please notify us of the problem at the time of cancellation.
On cancellation, you must return the goods to us at your cost unless the goods are being returned because they are faulty, incorrect goods or because of unsuitable substitution by us, in which case we will meet the cost of return but we ask that you allow us to nominate the carrier.
Refunds will be processed upon the receipt of returned goods in their original packaging and in good, sellable condition.
6. Governing Law and Jurisdiction
Contracts between you and Hogshead Publishing Ltd shall be governed by English
Law and all disputes shall be submitted to the non-exclusive jurisdiction
of the English courts.
7. Force Majeure
We shall have no liability to you for any failure or delay in supply
or delivery or for any damage or defect to goods supplied or delivered
hereunder that is caused by any event or circumstance beyond our reasonable
control (including, without limitation, strikes, lockouts and other
industrial disputes).
8. Invalidity of Terms and Conditions
If any part of these conditions is invalid, illegal or unenforceable
(including any provision in which we exclude our liability to you)
the validity, legality or enforceability of any other part of these
conditions will not be affected. This contract shall be governed by
and interpreted in accordance with English law.
9. Design and Reproduction
Drawings, photographs, layout and style are considered
property. Reproduction in whole, or in part, strictly prohibited without
written permission. Trademarks acknowledged. Exact products may vary from that shown. All products
subject to availability.
